With reference to your letter of the 31st October 1904, No: 36010, with enclosures, relative to the acquisition by the Admiralty from the Colonial Government of Hong Kong of the freehold interest in Kowloon Marine Lots Nos: 35 & 36 and Hong Kong Marine Lots Nos: 20 & 21;

I am commanded by the Lords Commissioners of the Admiralty to acquaint you, for the information of the Secretary of State for the Colonies, that the Deeds for the conveyance of these properties have now been received.

2. In the Conveyances, which are transmitted herewith, the following provisions are inserted :-

(a). The Colonial Government reserve the right to make and conduct in and through the said premises all and any public or common sewers, drains and watercourses;

(b). The Admiralty are not to sell or dispose of the premises conveyed otherwise than by way of surrender to the Colonial Government;

(c). The Admiralty are to bear, pay and allow a reasonable share and proportion for and towards the costs and charges of making, building and repairing and amending all or any roads, pavements, channels, fences &c., &c., sewers, drains &c., in common with other premises near or adjoining thereto.

3. In regard to (a), My Lords are of opinion that this right should only be exercised in the event of there being, in the opinion of both the Admiralty and the Colony, absolutely no alternative course by which the desired object could be attained.
